5km FOR THE MEN – Terms & Conditions
1. Event Overview
The 5km FOR THE MEN ("Event") is organised and delivered by Kylie Gates on behalf of Forest Lake Community Events Association Inc. (ABN 32 372 166 246) in support of Spoke to a Bloke Incorporated ("Spoke to a Bloke"), the nominated charity partner.
By registering for or participating in the Event, you acknowledge that you have read, understood and agree to these Terms & Conditions.
2. Role of the Parties
Forest Lake Community Events Association Inc. (ABN 32 372 166 246), through the Event Organiser, Kylie Gates, is solely responsible for the planning, organisation, management, supervision, safety and delivery of the Event, including obtaining any permits, approvals and insurance required to conduct the Event.
Spoke to a Bloke Incorporated acts solely as the nominated charity partner and, where applicable, the provider of an online fundraising platform.
Spoke to a Bloke does not organise, manage, supervise or control the Event and accepts no responsibility for the planning, delivery, safety or conduct of the Event.
Participants acknowledge that Spoke to a Bloke's involvement is limited to its role as the nominated charity partner.
3. Third-Party Event
This Event is an independently organised community event.
Participants acknowledge and agree that:
- Spoke to a Bloke does not organise, manage, supervise or control the Event.
- Any questions, concerns, complaints or claims relating to the Event should be directed to the Event Organiser.
- Participation in the Event is at the participant's own risk.
4. Participation & Assumption of Risk
Participation in the Event involves inherent risks, including but not limited to slips, trips, falls, illness, injury, accidents and other unforeseen incidents.
By participating, you confirm that:
- You are physically capable of participating.
- You voluntarily choose to participate at your own risk.
- You will follow all reasonable instructions provided by the Event Organiser and any volunteers assisting with the Event.
- You accept responsibility for your own safety and wellbeing throughout the Event.
5. Liability
To the fullest extent permitted by law:
- Participants accept all risks associated with participating in the Event.
- Forest Lake Community Events Association Inc., Kylie Gates (Event Organiser), their volunteers, and Spoke to a Bloke Incorporated are not liable for any loss, damage, injury, illness or expense arising from participation in the Event, except where liability cannot legally be excluded.
Nothing in these Terms & Conditions excludes any rights or remedies available under the Australian Consumer Law or any other applicable legislation.
6. Insurance
Participants are responsible for ensuring they are medically fit to participate and for obtaining any personal accident, health or other insurance they consider appropriate.
The Event Organiser is solely responsible for arranging and maintaining any insurance required for the conduct of the Event, including Public Liability Insurance where applicable.
Spoke to a Bloke Incorporated does not organise, manage or insure the Event and does not provide Public Liability Insurance or any other insurance cover for the Event or its participants.
7. Fundraising
Where fundraising is conducted in support of Spoke to a Bloke:
- Funds raised will be donated to Spoke to a Bloke Incorporated.
- Spoke to a Bloke may provide an online fundraising platform to facilitate donations.
- Spoke to a Bloke reserves the right to suspend or remove fundraising pages where necessary.
8. Photography & Media
By participating, you consent to photographs and video recordings being taken during the Event.
These images and recordings may be used by Forest Lake Community Events Association Inc., Kylie Gates and Spoke to a Bloke Incorporated for promotional, marketing, reporting and fundraising purposes across print, digital and social media.
If you do not wish to appear in photographs or video, please notify the Event Organiser prior to the commencement of the Event.
9. Privacy
Personal information collected during registration will be used for administering the Event, communicating with participants and facilitating fundraising activities where applicable.
Information will be handled in accordance with applicable Australian privacy legislation.
10. Event Changes
The Event Organiser reserves the right to amend, postpone, relocate or cancel the Event where necessary due to weather conditions, safety concerns or circumstances beyond their reasonable control.
Participants will be notified of any significant changes where reasonably practicable.
11. Shirts
Register at least three weeks before the event to guarantee your chosen shirt size. After 25 October shirts are subject to availability.
12. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
13. Acceptance of Terms
By registering for the Event, you acknowledge and agree that:
- You have read and understood these Terms & Conditions.
- You understand that 5km FOR THE MEN is organised by Forest Lake Community Events Association Inc. (ABN 32 372 166 246) through Kylie Gates, and not by Spoke to a Bloke Incorporated.
- You understand that Spoke to a Bloke acts solely as the nominated charity partner.
- You voluntarily participate in the Event at your own risk.
