WALK FOR A BLOKE – TERMS AND CONDITIONS OF PARTICIPATION (2026)
Spoke to a Bloke Incorporated (Australia) is a community-based men's mental health organisation dedicated to raising awareness, promoting connection, and supporting access to professional help. Through its flagship event, Walk for a Bloke, the organisation hosts community walks around the world to encourage open conversation about mental health and raise funds to support life-changing services. These Terms and Conditions outline the terms of participation in all Walk for a Bloke events worldwide.
All Walk for a Bloke events will take place on Saturday, 21 March 2026, except for India (Bangalore), which will take place on Saturday, 14 March 2026 (“Event”).
The Event is organised and conducted by Spoke to a Bloke Incorporated (Australia), its committee members, agents, volunteers and contractors (collectively “Spoke to a Bloke”).
Please carefully read these Terms and Conditions (“T&Cs”) of participation.
General Acknowledgements
By registering to participate in the Event, the participant (“You”) acknowledges and agrees with Spoke to a Bloke that You have read, considered and fully understand these T&Cs and agree to be bound by, and comply with, these T&Cs.
For the purposes of these T&Cs, all references to the ‘Event’ are a reference to all of those activities incidental to, or associated with, the Event, whether they are held or undertaken before, during, or after the Event.
Australia & New Zealand
- In Australia, the Event is a ‘recreational activity’ for the purposes of the Civil Liability Acts across States and Territories and forms part of a ‘contract for the supply of recreational services’ under section 139A of the Competition and Consumer Act 2010 (Cth).
- In New Zealand, the Event is considered a ‘recreational service’ under section 2 of the Consumer Guarantees Act 1993 (NZ), and Spoke to a Bloke’s liability is limited in accordance with the Consumer Guarantees Act 1993 (NZ) and the Contract and Commercial Law Act 2017 (NZ).
Europe (United Kingdom, Italy, Switzerland)
- In the United Kingdom, these T&Cs form part of a contract governed by the Consumer Rights Act 2015 (UK) and the Unfair Contract Terms Act 1977 (UK), under which liability for death or personal injury caused by negligence cannot be excluded, but all other liability may be limited to the fullest extent permitted by law.
- In Italy, these T&Cs are governed by the Italian Civil Code (Codice Civile) and Legislative Decree No. 206/2005 (Consumer Code), which regulate contracts for recreational and consumer services. Spoke to a Bloke excludes liability to the maximum extent permitted under Articles 1229 and 1341 of the Italian Civil Code.
- In Switzerland, the Event is subject to Articles 97–101 and 100 of the Swiss Code of Obligations (CO) and relevant provisions of the Swiss Civil Code, which allow for the limitation of liability in contracts for voluntary or recreational activities.
Asia (India, Philippines)
- In India, these T&Cs are governed by the Indian Contract Act 1872 and the Consumer Protection Act 2019 (India). Participants acknowledge that Spoke to a Bloke excludes liability for any injury, loss, or damage except in cases of gross negligence or wilful misconduct.
- In the Philippines, participation in the Event is governed by the Civil Code of the Philippines and Republic Act No. 7394 (Consumer Act of the Philippines). Spoke to a Bloke’s liability is limited to the extent allowed under Articles 1170–1174 of the Civil Code.
Africa (South Africa)
- In South Africa, these T&Cs form part of a contract under the Consumer Protection Act 68 of 2008 (South Africa). Spoke to a Bloke limits its liability for recreational activities to the fullest extent permitted under section 49 of the Act.
Group Registrations and Authorisation
Where a person (“Group Organiser”) registers multiple participants for the Event as part of a group registration or purchases tickets on behalf of others, the Group Organiser warrants that they have the authority to accept these Terms and Conditions on behalf of each participant included in the group registration. The Group Organiser acknowledges that they have provided a copy of these Terms and Conditions to each participant prior to registration and agrees that all participants registered under that group registration are deemed to have read, understood, and agreed to be bound by these Terms and Conditions as if they had registered individually. The Group Organiser indemnifies Spoke to a Bloke Incorporated (Australia) against any claim, demand, or loss arising from a failure by any group participant to comply with these Terms and Conditions.
Spoke to a Bloke may, at its discretion, require confirmation from any participant that they have been made aware of, and agree to, these Terms and Conditions.
Participants who register for and participate in the “Walk Anywhere” option acknowledge and agree that their participation is undertaken voluntarily, independently, and at a location of their own choosing anywhere in the world. All terms, conditions, acknowledgements, waivers, exclusions, and limitations of liability contained in these Terms and Conditions apply equally to “Walk Anywhere” participants, regardless of their geographic location.
For the purposes of “Walk Anywhere” participation:
• Jurisdiction: These Terms and Conditions are governed by, and construed in accordance with, the laws of the country in which the participant is physically located at the time of their participation. Each participant submits to the non-exclusive jurisdiction of the courts of that country.
• Assumption of Risk: Participants acknowledge that “Walk Anywhere” activities are self-directed and not supervised by Spoke to a Bloke Incorporated (Australia). Participants are solely responsible for selecting a safe walking route, complying with local laws and regulations, and ensuring their own safety and wellbeing during the activity.
• Insurance: Participants understand that Spoke to a Bloke does not provide insurance coverage for “Walk Anywhere” participants and that they are responsible for obtaining any personal or travel insurance deemed necessary.
• Indemnity: Participants indemnify Spoke to a Bloke Incorporated (Australia) and its representatives from any claims, losses, or damages arising from or in connection with their independent participation in the “Walk Anywhere” Event.
Walk Anywhere Events – Global Coverage
Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the country in which the Event is held. Each participant agrees to submit to the non-exclusive jurisdiction of the courts in that country. Where any provision of these Terms and Conditions is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
General Reservation of Rights
Spoke to a Bloke reserves the right, in its absolute discretion, to:
- accept or refuse any applications for entry into the Event and disqualify prospective participants (including but not limited to You); and
- change these T&Cs from time to time, without notification to You.
Risk Notice
You understand that participation in the Event may involve exposure to inherent risks of:
- harm, injury or illness associated with physical exercise, exertion and fatigue, including (but not limited to) heart attack, fainting and loss of consciousness;
- harm or injury arising from (but not limited to):
- slippery or uneven surfaces, obstacles, trip hazards, overcrowding, collision with objects, vehicles or people;
- the effects of heat, cold, dehydration, and exhaustion;
- falls, such as broken bones, sprained muscles, injuries to ligaments, cartilage, or other soft tissue; and
- friction and abrasion, such as blisters, cuts, abrasions and lacerations; and
- illness or injury arising from exposure to people in public places, including (but not limited to) an increase in your risk of exposure to and contraction of communicable disease(s), whether in the form of COVID-19 or otherwise.
You acknowledge that the above is not an exhaustive list of all risks inherent in your participation in the Event and that there may be risks that are neither known nor reasonably foreseeable to Spoke to a Bloke at the time of your acceptance of these T&Cs.
By registering to participate in the Event and accepting these T&Cs, You warrant to Spoke to a Bloke that:
- You are in proper physical and mental condition; and
- You have no known medical conditions or disabilities that may be incompatible with or jeopardise your safe participation in the Event.
You understand that Spoke to a Bloke recommends that You consult a doctor before participating in, and preparing for, the Event regardless of your health history, although particularly in the event that You have suffered or suffer from any illness, injury or medical condition(s) that may increase the risk for You to safely participate in the Event.
Regardless of whether You have consulted a doctor, You acknowledge and agree that by participating in the Event:
- You are aware of the risks associated with the Event; and
- You voluntarily assume any and all of those risks associated with the Event, including (but not limited to) those risks arising from the negligence of Spoke to a Bloke.
The abovementioned assumption of risk extends to any minors accompanying You for the purposes of participation in, and preparation for, the Event.
Insurances
You understand that Spoke to a Bloke has not obtained personal accident insurance or any other insurance covering your participation in the Event and it is your responsibility alone to obtain any and all insurance which You deem to be appropriate for the purposes of participation in, and preparation for, the Event.
Exclusion and Limitation of Liability
You understand and agree that, to the extent permitted by law, Spoke to a Bloke and any sponsor of the Event (including any of their directors, officers, employees, volunteers, agents, and representatives) excludes all liability to You for damages for any harm (including but not limited to personal injury or death, damage to property and economic loss and whether direct, indirect, special or consequential) arising from a failure by Spoke to a Bloke or any sponsor of the Event to exercise reasonable care and skill, regardless of whether the claim is brought in tort (including (but not limited to) in negligence), in contract, under statute or otherwise, where such liability results from breach of an express or implied warranty that the services of and incidental to the Event will be rendered with reasonable care and skill.
You understand and agree that to the maximum extent permitted by law:
- all conditions, warranties, guarantees, rights, remedies, liabilities, or other terms implied or conferred by statute, custom, or the general law that impose any liability or obligation on Spoke to a Bloke or any sponsor of the Event (or their directors, officers, employees, volunteers, agents, and representatives) are excluded, including consumer guarantees to the extent such exclusions are permitted under the law;
- neither Spoke to a Bloke nor any sponsor of the Event (nor any of their directors, officers, employees, volunteers, agents, and representatives) will be liable to You or any other person in contract, tort (including (but not limited to) negligence), or otherwise, for any loss, damage, cost, or expense of any kind (including direct, indirect or consequential losses, damages, costs, and expenses) suffered or incurred by You or any other person in connection with the Event; and
- in any circumstances where any or all of the abovementioned exclusions are held by a Court to be ineffective or unenforceable for any reason whatsoever, Spoke to a Bloke’s liability to You and to any other person is limited (at the option of Spoke to a Bloke) to:
- re-supplying, repairing, or replacing the service; or
- the payment of the cost of re-supplying the service to You.
Section 139A of the Competition and Consumer Act 2010 (Cth) ("CCA") permits a term of a ‘contract for the supply to a consumer of recreational services’ to exclude liability of the supplier for the death and personal injury arising from the failure to comply with a guarantee provided in sections 60 to 62 of the Australian Consumer Law.
You understand and agree that, to the maximum extent permitted by section 139A of the CCA, Spoke to a Bloke and any sponsor of the Event (including any of their directors, officers, employees, volunteers, agents, and representatives) excludes all liability in connection with the supply of recreational services for:
- death;
- physical or mental injury;
- the aggravation, acceleration, or recurrence of physical or mental injury (whether underlying or otherwise);
- the contraction, aggravation, or acceleration of a disease (whether underlying or otherwise); and
- the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to an individual (whether underlying or otherwise), that is or may be harmful or disadvantageous to the individual or community, or that may result in harm or disadvantage to the individual or community,
resulting from a failure of Spoke to a Bloke and any sponsor of the Event (including any of their directors, officers, employees, volunteers, agents, and representatives) to comply with a guarantee in sections 60 to 62 of the ACL.
Spoke to a Bloke acknowledges and agrees that the abovementioned exclusion of liability does not apply where significant personal injury is caused or contributed to by the reckless conduct of Spoke to a Bloke or any sponsor of the Event.
Release and Indemnity
You acknowledge and agree to fully and irrevocably exclude and release Spoke to a Bloke and any sponsor of the Event (including any of their directors, officers, employees, volunteers, agents, and representatives), from any and all liability for any loss, damage, cost, or expense (whether in negligence, contract, under statute or otherwise) suffered by You as a consequence of:
- your involvement in the Event, including in relation to death and personal injury;
- in connection with or in respect of any breach of these T&Cs; and
- in connection with the publication or distribution of any material or information that You supply to Spoke to a Bloke in the course of participating in the Event.
If any claim, including (but not limited to) in relation to personal injury, property damage or wrongful death arising from your participation in the Event, is commenced, then You agree to indemnify and hold harmless Spoke to a Bloke and any sponsor of the Event (including any of their directors, officers, employees, volunteers, agents, and representatives), from any and all loss, damage, cost, or expense in connection with such claim.
Public Venue and Persons Giving Directions
You acknowledge and agree:
- that the Event will be conducted (whether in whole or in part) on premises or property made available for use by the general public;
- to be bound by all laws, rules and regulations that may apply to that public premises or property; and
- to follow the directions of:
- any person duly authorised on behalf of Spoke to a Bloke in the conduct of the Event; and
- any other person duly authorised to give directions to You regarding the use of the public premises or property.
Privacy Policy
By registering to participate in the Event, You acknowledge and agree with Spoke to a Bloke that You have read, considered and fully understand and agree to the Privacy Policy.
Photographic Consent
You acknowledge that in the course of the Event, photographic and/or videographic material may be taken of You, either alone or together with other participants in the Event.
You agree:
- to the use of your image in these photographs and/or videos in Spoke to a Bloke publications, or on social media sites or websites in the future;
- that Spoke to a Bloke may lawfully use your name and/or likeness in conjunction with any of the photographs and/or videos taken of You; and
- that the photographs and/or videos may be lawfully used by third party media organisations in connection with the publicity and reporting of the Event in the public domain.
Fundraising
You acknowledge and agree that registration to participate in the Event is also an application by yourself to Spoke to a Bloke (as the relevant licence holder) for an authority to fundraise for charitable purposes pursuant to the applicable laws and regulations relating to fundraising within the specific jurisdiction in which You participate in the Event (“Fundraising Laws”).
In participating in the Event, You acknowledge and agree that You are responsible for:
- conducting fundraising activities of and incidental to the Event in accordance with the Fundraising Laws and these T&Cs; and
- obtaining any additional licences, permits, or approvals required by the Fundraising Laws to lawfully conduct any fundraising activities of and incidental to the Event.
- that fundraising activities must comply with the laws of the State or Territory in which the fundraising occurs.
Pending completion of registration for the Event, You:
- will be approved and authorised by Spoke to a Bloke to fundraise for purposes of and incidental to the Event and for the duration of the Event; and
- agree and accept that Spoke to a Bloke will manage and provide You with a fundraising account relating to the Event on the Event’s fundraising platform.
In the event that:
- You are temporarily or permanently incapacitated; or
- You die,
after registering for the Event, You authorise and agree for Spoke to a Bloke to contact your listed next of kin to determine how your Event fundraising account will be managed. Options will include (amongst other things) closing your Event fundraising account or updating your Event fundraising account to be ‘in memorial of’ for the remainder of the Event fundraising period.
You acknowledge and agree that:
- access to your Event fundraising account cannot be provided by Spoke to a Bloke to any of the following:
- your next of kin;
- your team organisers; or
- your team members,
to protect the privacy of donors; and
- all access to your Event fundraising account will be managed confidentially by Spoke to a Bloke staff.
You acknowledge that, without further express authority from Spoke to a Bloke to fundraise, You are not permitted to identify Spoke to a Bloke as a charity associated with the Event or to use the Spoke to a Bloke name, logo, likeness or any other material associated with Spoke to a Bloke in preparing for, organising, or participating in the Event, including but not limited to marketing or promoting the Event.
You acknowledge and agree that Spoke to a Bloke may, in its absolute discretion, withdraw the authority to fundraise granted to You at registration, upon which You must immediately cease participation in the Event and discontinue any use of the Spoke to a Bloke name, logo, likeness or other identifying material.
